Derby moped collision claim may be made
Following a road traffic accident in Mickleover, Derby, the victim or her family, may choose to make a moped collision claim.
The 41-year-old rider was thrown from her 50cc vehicle when it crashed with a car.
It has not been reported as to whether the woman was wearing a helmet, but she suffered a serious head injury.
She was taken to Royal Derby Hospital before being transferred to Queen's Medical Centre in Nottingham. The casualty was described as still being in a critical condition the morning after the incident.
Information about the driver of the car involved has not been released, but the police is now investigating the crash and appealing for any witnesses to come forward with information which could help determine who is liable for the incident.
If the motorist is found guilty of driving dangerously, or without due care and attention, then the casualty or her family could make a moped collision claim.
If on the other hand the rider is found to be entirely at fault, then a compensation claim is unlikely to be made by either of the individuals involved.
