Bereaved daughter receives compensation in India

The Indian car accident was not uncommon, a businessman killed when a truck collided with his car in April 2000. But the accident left his nine-year-old daughter an orphan as her mother had already passed away just a year previously.

Now, the Thane Motor Accident Tribunal has awarded a substantial amount of car accident compensation, more than 12 years after the incident.

Initially, the girl, and her car accident claim solicitors, petitioned for Rs 15 lakh (approx. £17,800), from the owner of the truck and the insurance company National Insurance who were found to be jointly liable for the accident. However, once the court had examined the finances of the deceased private business owner it ruled that the total payout should be Rs 12 lakhs (approx. £14,200).

Neither of the liable parties was represented in the court hearings regarding the claim for car accident compensation, and initially no payments were made.

However, compensation amounts have been paid to the court (with interest factored in) and funds have been released to the girl, now 21.
