M4 car accident compensation for fatality not possible
The family of a 23-year-old man, who died on the M4 near Bristol, will not be able to claim car accident compensation for their loss.
The incident occurred when the man lost control of his vehicle and crashed in the third lane of the carriageway. The driver managed to get his mother and his 5-year-old daughter to safety, but was hit by a car when another motorist tried to swerve out of the way to avoid the victim's stationary vehicle.
The victim was thrown over the car's bonnet and landed on the road, suffering a fatal head injury.
During police investigations an officer stated that due to the lack of light at the time of the accident and how little time the other motorist involved was given to react, ""It's highly improbable that [he] could have avoided the collision."
After deliberation by the investigative team and the court, the coroner recorded the man's death as "accidental". Because of this, his family will not be able to pursue a car accident compensation claim against the driver who was in a collision with the victim.
