The female claimant, who suffered severe injuries in the car crash, sought £3million in personal injury compensation from her boyfriend who was driving at the time of the crash.
It is alleged that the Honda Civic the woman was travelling in was being driven at speed and was racing a Ford Focus along the road between Avon and Munlochy when the car accident occurred.
It is estimated that the Honda Civic was travelling at around 90mph when the driver attempted an overtaking manoeuvre that resulted in him losing control of the car, causing it to roll into a field.
The female claimant suffered a broken pelvis and spinal damage in the incident and has lost all feeling in her legs.
The judge has ruled that both the driver of the Honda and the driver of the Focus will share responsibility for the crash.
The two drivers will therefore also share the compensation payout for the accident claim with 80% of the amount being met by the Honda driver and 20% by the Focus driver.
