No win, no fee – doesn’t mean no cost
No win, no fee arrangements cover your legal fees if your case is unsuccessful, but they don’t always mean you are free from all costs. By implication they mean if you win, you have to pay costs, and if you lose you will be liable for the other person’s legal fees.

Some solicitors may require you to make a payment up front to fund your case. They may also take a percentage of your final compensation.

If your claim is unsuccessful an insurance policy (which will be taken out on your behalf) will cover your costs and the other person’s legal costs. The cost of the insurance policy (as long as it is deemed reasonable by the Court) will be paid for by the other person’s insurance company if you win your claim. If you lose, the premium itself is covered by the policy – so our no win, no fee policy means you are protected from costs at all times.
