Irish personal injury system open to debate

An Irish motorcycle accident claim has prompted debate within the country about the nature of its personal injury compensation system.

The 30-year-old motorcycle accident victim was recently awarded €4.98 million after being involved in a crash while travelling pillion with a friend near a golf club in Cork.

However, despite making the award, the judge hearing the case expressed concerns about difficulties within the Irish system of providing sums for a claimant's future care.

He suggested that it was time legislators looked to change the Irish system so that it more closely followed that of the UK. "The current UK model is based on periodic payments and it is infinitely better," he said.

He likened trying to provide a full sum for future payments to "looking into a crystal ball".

"What really needs to be done is to change the system," he added.

The claimant's personal injury solicitor had earlier told the court how his client now suffered from both permanent physical and permanent intellectual disabilities.

The motorcycle accident compensation award will come as a relief to both the claimant and his family, who have incurred significant costs in caring for the injured man.
