A rider who was left paralysed in a motorcycle accident in Cheshire has been told he can make a compensation claim on the basis of a finding of 75 percent liability.
The judge hearing the motorcycle accident case at Manchester County Court disagreed with the defendant solicitor's argument that the claimant had been driving at an excessive speed and had therefore been the "author of his own misfortune".
Instead he concurred with claimant personal injury solicitor arguments that the crash happened when the rider was overtaking a line of traffic only for a car driver to pull out from a side road without first indicating or checking in his wing mirror. Still, the 75 percent liability ruling means that the rider is considered 25 percent responsible for his motorcycle accident injuries.
A settlement will be negotiated over the coming months.
