Essex man wins complex injury claim

A London High Court hearing as overseen the award of £450,000 motorbike accident compensation to a 20-year-old Essex man who suffered life-changing injuries in a 2004 collision with a car.

The man, who was 16 at the time of accident, had been travelling as pillion passenger on a 15-year-old friend's motorcycle when the incident occurred.

Despite the fact that the 15-year-old was unlicensed, leading the judge to describe the incident "as an accident waiting to happen", he also stated said that had the motorbike accident compensation claim gone to full trial he could easily have ruled that the car driver could should have seen the motorcycle and prevented the accident from occurring.

The personal injury solicitor representing the young man's claim admitted that his client would find it hard to defend himself from accusations that he should never have allowed himself to be the passenger of "such an inexperienced and unqualified rider".

He also said that the settlement represented "quite a modest sum" for the extent of the 20-year-old's injures, which included broken bones and brain damage, but added that any considerations of the size of the motorbike accident compensation award must take account of the complex nature of the case.

Tragically, the claimant will now need to be cared for and supported for the rest of his life.
