Insurance company to fund legal action for compensation claim following road accident

A former nurse who lost her leg in a horrific road traffic accident in Turkey in July 2002, has won a Court appeal that means her holiday insurance company will cover her legal costs so she can make a compensation claim.

The road accident happen when the 40 year old mother, whose son and then-partner were also injured, were travelling by coach to a boat excursion, when it was hit by a lorry. A claim had initially been made against the tour operator, Thomas Cook, with whom they had booked the holiday. However, despite the excursion being booked by the tour operator’s own agent in Turkey, Liverpool County Court last year ruled that Thomas Cook could not be sued for this accident, as under the 1992 package holiday regulations, tour operators are only liable for excursions that are booked in this country.

Compensation solicitors for the women turned to her travel insurer Financial Insurance Company (FIC) for help to fight the case in the Turkish courts. FIC initially refused to fund any legal action, saying that their policy excluded claims against the carrier, in this case Thomas Cook. The case was referred to the Insurance and Services Ombudsman, who have upheld the appeal stating the wording of the FIC policy was ambiguous in this case.

Finally, three years later, the case against the Turkish coach company can now go ahead. Despite having had a prosthetic limb fitted, the woman has been unable to return to work as a nurse because of her injuries. Her solicitors will be claiming £100,000 in compensation for her injuries and the devastating impact the accident has had on her life.
