Personal injury compensation claim procedure

  • Once you have instructed us to take on your claim, our solicitors will start work on organising everything needed to make a claim against the person who caused the accident
  • A ‘Letter of Claim’ will be sent to the other person’s car insurance company, giving notice that you intend to pursue a claim for personal injury compensation against them
  • Witness statements, police reports and other information will be gathered together to support your claim
  • We will ask you to complete a questionnaire which covers every aspect of your claim, to ensure you receive the full compensation entitlement
  • At this stage your claim will be passed to a claim negotiator. Their role is to ensure you receive the best possible compensation award
  • A ‘Schedule of Losses’ will be put together which details all the financial losses (Heads of Claim) that you are making a claim for
  • The ‘Schedule of Losses’ will be sent to the third party’s insurance company, with a request for the claim to be settled

What if there is a dispute over liability?
Most cases are undisputed and there is little complication. However, if there is a dispute, or where agreement cannot be reached as to the amount the compensation claim is settled at, it may then be necessary to issue Court proceedings.
