Making an accident claim
More often than not, being involved in a car crash is a traumatic event, and making an accident claim can be the last thing on your mind. However, the financial implications of time off work and treatment costs can prove significant, so claiming compensation should definitely be considered, especially if the accident was not your fault.
Know your rights
It’s important to be aware that the law allows anyone who has been hurt in an accident that was not their fault to make a claim for accident compensation within three years. This is an acknowledgement that there is pain and suffering as a result of an accident and also financial losses such as prescription costs, treatment, phone calls, loss of earnings, policy excess etc. In addition to being entitled to compensation for the physical effects of the accident, it is unfair that you should have to be out of pocket financially if the accident wasn’t your fault.
How much compensation will I get?
Injuries and their severity vary greatly from person to person, so therefore the compensation amounts do too. How much you will get depends very much on the circumstances of your accident, but our solicitor will be able to give a fairly clear idea once we know more about your accident.
What do I have to do to make an accident claim?
It’s important that you contact us as soon as possible to make your accident claim. We’ll ask you to start keeping a diary charting your recovery from the injury and what sort of treatment you receive. We’ll also ask you to keep receipts and invoices for any money you spend in relation to your injury – including travel expenses and costs of medicines.
Will I have to go to Court?
The vast majority of accident claims – well over 90% - are settled long before they ever get as far as the Court room. However, in certain cases where liability is disputed or where there are potentially large sums of compensation involved, it can be beneficial to go to Court to ensure your accident claim has the best possible outcome. However, rest assured that your solicitor will have a very clear idea whether or not this is likely and will keep you up to date at every stage of the proceedings.
